These Terms and Conditions of Sale ("Terms") govern all purchases made through the KingNorwe TCG website available at:
Please read these Terms carefully before placing an order. By purchasing products through the Website, you agree to be legally bound by these Terms.
DEFINITIONS
For the purposes of these Terms, the following definitions shall apply:
Seller means KingNorwe TCG SAS, a French simplified joint-stock company (Société par Actions Simplifiée – SAS), registered with the Lyon Trade and Companies Register under number 101 494 409, whose registered office is located at 51 rue Deleuvre, 69004 Lyon, France.
Website means the online store operated by the Seller and accessible at:
Customer means any natural or legal person purchasing Products through the Website.
Consumer means any natural person acting for purposes outside their trade, business, craft or profession, as defined by applicable consumer protection laws.
Products means all goods offered for sale through the Website, including but not limited to individual trading cards, sealed products, graded cards, accessories, collectibles, merchandise and preorder items.
Order means any purchase request submitted by the Customer through the Website.
Contract means the legally binding sales agreement concluded between the Seller and the Customer upon acceptance of an Order.
Terms means these Terms and Conditions of Sale, including any annexes incorporated by reference.
ARTICLE 1 — PURPOSE AND SCOPE
1.1 Purpose
These Terms govern every sale of Products concluded through the Website between the Seller and the Customer.
They define the respective rights and obligations of both parties throughout the ordering process, payment, delivery, returns, statutory guarantees and any other matter arising from the purchase of Products.
Nothing in these Terms limits or excludes any mandatory rights granted to Consumers under applicable law.
1.2 Acceptance of the Terms
By placing an Order through the Website, the Customer acknowledges that they have read, understood and accepted these Terms without reservation.
Acceptance is confirmed by selecting the appropriate checkbox during checkout before completing the Order.
Customers who do not accept these Terms must refrain from placing an Order.
1.3 Applicable version
The version of the Terms applicable to an Order is the version published on the Website at the time the Order is placed.
The Seller reserves the right to amend these Terms at any time.
Any amendment shall apply only to future Orders and shall not affect Contracts already concluded.
1.4 Priority of the Terms
These Terms constitute the entire agreement between the Seller and the Customer regarding purchases made through the Website.
They prevail over any conflicting document or purchasing conditions issued by the Customer, unless expressly accepted in writing by the Seller.
1.5 Mandatory consumer rights
Nothing contained in these Terms shall deprive Consumers of any mandatory protection granted by:

2.1 Japanese logistics
Although Products may be stored, prepared and shipped from Japan, the contractual seller always remains KingNorwe TCG SAS, the French company identified above.
Order fulfilment, sourcing, warehousing and logistics may be carried out by KingNorwe TCG GK, a Japanese company acting solely as a logistics and operational partner.
Its involvement does not modify the identity of the Seller.
The Customer enters into a sales contract exclusively with KingNorwe TCG SAS.
ARTICLE 3 — PRODUCTS
3.1 General information
The Website offers a selection of authentic trading card products and related merchandise, including but not limited to:

Individual trading cards;

Factory-sealed products;
-
Graded cards;
-
Trading card accessories;
-
Collectibles;
-
Merchandise;
-
Preorder Products.
Each Product page describes the essential characteristics of the Product before purchase.
Customers remain responsible for reviewing all information displayed before placing an Order.
3.2 Product photographs
Unless expressly stated otherwise, photographs displayed on the Website accurately represent the Product offered for sale.
However:

colours may vary depending on screen settings;
-
lighting may slightly affect appearance;
-
packaging may vary between production batches.
Minor visual differences that do not affect the essential characteristics of the Product shall not constitute a lack of conformity.
Where photographs show the exact individual card being sold, those photographs form an integral part of the Product description.
3.3 Individual cards
Unless otherwise indicated, individual cards sold through the Website are genuine products.
Card condition is assessed according to generally recognised standards within the trading card community.
Condition grading necessarily contains a degree of subjective appreciation.
A card described as Near Mint may legitimately display minor manufacturing or handling imperfections consistent with that condition, including:

slight edge wear;
-
minor surface marks;
-
print lines;
-
centring imperfections;
-
factory defects commonly accepted within the hobby.
Unless specifically advertised as professionally graded, no condition assigned by the Seller guarantees any future grading result from PSA, BGS, CGC or any other grading company.
3.4 Sealed Products
Products described as sealed are supplied in their original factory-sealed packaging.
The content of sealed trading card products is entirely random and determined exclusively by the manufacturer.
Accordingly, the Seller cannot guarantee:
-
the pull rate of any rarity;
-
the presence of any specific card;
-
serial-numbered cards;
-
signature cards;
-
alternate arts;
-
chase cards;
-
any other randomly inserted content.
The random distribution of cards is an intrinsic characteristic of sealed trading card products and shall not constitute a defect or lack of conformity.
3.5 Graded cards
Where a Product has been graded by a third-party grading company, the assigned grade reflects solely the opinion of that grading company.
The Seller does not guarantee that:

another grading company;
-
or the same grading company upon resubmission;
would assign the same grade.
Minor cosmetic imperfections affecting only the protective holder ("slab") do not affect the authenticity or grade of the enclosed card unless otherwise specified.
3.6 Preorder Products
Products offered for preorder are Products not yet available for immediate shipment.
Any release date, allocation estimate or shipping window displayed on the Website is provided in good faith but remains indicative only.
Manufacturers, publishers, distributors or suppliers may postpone release dates, reduce allocations or cancel Products without prior notice.
The specific rules applicable to preorder payments, allocations and cancellations are detailed in Article 6.
ARTICLE 4 — ORDERS
4.1 Placing an Order
To place an Order, the Customer must:

Select the desired Product(s);

Add the Product(s) to the shopping cart;

Review the contents of the Order;

Provide complete and accurate billing and shipping information;

Select an available shipping method;
-
Select an available payment method;
-
Read and accept these Terms;

Confirm the Order and complete payment.
Before submitting an Order, the Customer is responsible for verifying the accuracy of all information provided.
The Customer may correct any input errors before the Order is finally confirmed.
4.2 Order Confirmation
After the Order has been submitted, an acknowledgement email will be sent to the email address provided by the Customer.
This acknowledgement confirms receipt of the Order but does not necessarily constitute final acceptance.
The sales contract is deemed concluded only when:

payment has been successfully authorised or received; and

the Seller has accepted the Order.
The Seller reserves the right to carry out reasonable verification procedures before accepting an Order.
4.3 Product Availability
All Products are offered subject to availability.
Despite careful inventory management, stock discrepancies may occasionally occur due to:

simultaneous purchases;

inventory errors;
-
damaged stock;
-
supplier shortages;
-
allocation reductions;
-
other unforeseen circumstances.
If a Product becomes unavailable after payment has been received, the Seller will promptly inform the Customer and, where appropriate, offer one of the following solutions:

shipment of the remaining available Products;

replacement with an equivalent Product (subject to the Customer's prior consent);

partial refund;
-
full cancellation and refund.
No substitute Product shall ever be supplied without the Customer's express agreement.
4.4 Right to Refuse or Cancel an Order
The Seller reserves the right to refuse or cancel an Order for any legitimate reason, including but not limited to:

suspected fraud;

unauthorised payment;

inaccurate customer information;

manifest pricing errors;

technical errors affecting the Website;

abusive purchasing behaviour;

impossibility of supply;

legal restrictions;

force majeure.
Any payment already received for a cancelled Order shall be refunded in accordance with applicable law.
4.5 Customer Responsibility
The Customer is solely responsible for ensuring that all information provided when placing an Order is accurate, complete and up to date.

The Seller shall not be liable for delivery delays or failed deliveries resulting exclusively from incorrect information supplied by the Customer.
Requests to modify or cancel an Order must be submitted as soon as possible.
Although the Seller will make reasonable efforts to accommodate such requests, no modification can be guaranteed once order preparation has begun.
ARTICLE 5 — PRICES
5.1 Product Prices
Prices displayed on the Website are expressed in the currency selected by the Customer or otherwise displayed during checkout.
Unless expressly stated otherwise, displayed prices include all taxes that the Seller is legally required to collect at the time of purchase.
Shipping costs are calculated separately and displayed before the Order is confirmed.
5.2 Customs Duties and Import Charges
As Products may be shipped from Japan, deliveries to certain countries may be subject to:

5.3 Applicable Price
The applicable price is the price displayed at the moment the Customer confirms the Order.
Subsequent price changes shall not affect Orders already accepted.
5.4 Manifest Pricing Errors
Despite reasonable precautions, exceptional pricing errors may occur.
Where a pricing error is obvious and the Customer could reasonably have recognised it as such, the Seller reserves the right to cancel the affected Order before shipment.
In such circumstances, any payment already received shall be refunded in full.
This provision shall not apply merely because a Product was offered at a genuine promotional price.
5.5 Promotional Offers
Discounts, promotional codes and special offers apply only under the conditions specified on the Website.
Unless expressly stated otherwise:

promotional offers cannot be combined;

promotional codes have no cash value;

expired promotional codes cannot be reactivated.
ARTICLE 6 — PAYMENT
6.1 Payment Terms

6.5 Refunds

6.6 Preorders
Unless expressly stated otherwise, preorder Products are charged in full when the Order is placed.
Payment reserves the Customer's position within the Seller's available allocation but does not guarantee unlimited availability.
The Seller may cancel a preorder where:

the manufacturer cancels the Product;

the distributor cannot fulfil the allocation;

available allocations are reduced;
-
importation becomes impossible;

legal restrictions prevent delivery;

another circumstance beyond the Seller's reasonable control prevents fulfilment.
Where the Seller cancels a preorder, the Customer shall receive a full refund.
Where an Order contains both preorder Products and immediately available Products, shipment arrangements shall follow the option selected during checkout or otherwise indicated on the relevant Product pages.
ARTICLE 7 — DELIVERY
7.1 Delivery Destinations
The Seller ships to the destinations available during checkout.
Certain countries may become unavailable due to:

legal restrictions;

carrier limitations;
-
sanctions;
-
customs regulations;
-
logistical constraints.
The Seller reserves the right to decline shipments where delivery would be unlawful or impossible.
7.2 Preparation and Delivery Times

Unless expressly guaranteed, delivery dates remain estimates only.
Reasonable delivery delays shall not automatically entitle the Customer to compensation.

7.5 Inspection Upon Delivery

Such evidence greatly facilitates investigations with shipping carriers.
7.6 Incorrect Delivery Information
Customers are solely responsible for providing an accurate shipping address.
Where a parcel is returned due to incorrect delivery information supplied by the Customer, any additional shipping costs may be charged before reshipment.
7.7 Lost or Damaged Parcels
If a parcel is believed to be lost or arrives damaged, the Customer should notify the Seller as soon as reasonably possible.
The Seller may initiate an investigation with the carrier before determining the appropriate remedy.
Where required under applicable law, the Seller shall provide an appropriate remedy, including replacement, repair, price reduction or refund.
7.8 Transfer of Risk
For Consumers, the risk of loss or damage transfers only when the Products are physically received by the Customer or a third party designated by the Customer.
Where applicable law permits otherwise, different rules may apply where the Customer independently selects a carrier not proposed by the Seller.
7.9 Force Majeure Affecting Delivery
The Seller shall not be liable for delays resulting exclusively from extraordinary circumstances beyond its reasonable control, including but not limited to:

natural disasters;
-
war;
-
pandemics;
-
customs restrictions;
-
transport disruptions;
-
postal strikes.
The Seller shall nevertheless make reasonable efforts to keep Customers informed throughout such events.
7.10 Returned Shipments
Where a shipment is returned because:

the address provided was incorrect;
-
delivery was refused without legal justification;
-
the parcel was not collected;
-
customs charges were refused;
-
import formalities were not completed;
the Seller shall contact the Customer to determine whether:

the shipment should be resent; or
-
the Order should be refunded.
Where reshipment is requested, additional shipping costs may apply.
Where a refund is issued, the Seller may deduct only the costs actually incurred as permitted by applicable law.
No deduction exceeding the actual costs incurred shall ever be applied.
ARTICLE 8 — RIGHT OF WITHDRAWAL
8.1 Statutory Right
Consumers benefit from the statutory right of withdrawal provided by applicable consumer protection legislation.
Unless an exception applies, Consumers may withdraw from the Contract within fourteen (14) days without providing any reason.
8.2 Exercising the Right of Withdrawal
To exercise the right of withdrawal, the Consumer must notify the Seller before expiry of the withdrawal period by sending a clear statement of their decision.

8.3 Returning Products
Returned Products must be sent within the statutory deadline.
Products should be:

complete;

adequately protected;

returned with all accessories where applicable.
The Seller will provide the appropriate return address following validation of the return request.
8.4 Diminished Value
Consumers remain liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Products.
For trading card products, diminished value may result from:

opening sealed Products;

removing protective seals;
-
damaging packaging;
-
altering graded slabs;
-
missing accessories.
Any deduction shall always correspond exclusively to the actual loss in value.
8.5 Return Costs
Unless otherwise required by law, the direct cost of returning Products under the right of withdrawal shall be borne by the Consumer.
8.6 Refund
Once the legal conditions have been satisfied, the Seller shall reimburse the Consumer in accordance with applicable legislation.
Refunds shall generally be issued using the original payment method.
8.7 Exceptions
The statutory right of withdrawal does not apply where an exception provided by applicable law exists.
Nothing in this Article limits the Consumer's statutory rights relating to defective or non-conforming Products.
ARTICLE 9 — STATUTORY WARRANTIES
9.1 Statutory Consumer Rights
Nothing contained in these Terms shall limit or exclude any statutory rights granted to Consumers under applicable law.
Where applicable, Consumers benefit from the legal remedies provided under French law, including the statutory warranty of conformity and the warranty against hidden defects.
Consumers residing outside France may also benefit from mandatory consumer protection provisions applicable in their country of habitual residence where such provisions cannot legally be waived.
9.2 Conformity of Products
The Seller undertakes to supply Products that conform to the Contract.
Where a Product does not conform to the Contract, the Consumer may be entitled, subject to the applicable legal conditions, to one or more of the following remedies:

repair;

replacement;

price reduction;

termination of the Contract;

reimbursement.
The remedy available shall depend upon the nature of the defect and the applicable legislation.
9.3 Hidden Defects
Where applicable, Consumers may also rely upon the statutory warranty against hidden defects under French law.
A hidden defect is a defect existing at the time of sale which renders the Product unsuitable for its intended use or significantly reduces that use.
Nothing contained in these Terms limits those statutory rights.
9.4 Warranty Claims

The Seller may request the return of the Product where reasonably necessary to assess the claim.
9.5 Characteristics Specific to Collectible Products
Trading cards and collectible products may naturally display manufacturing characteristics such as:

centring variations;
-
print lines;
-
minor factory imperfections;
-
cutting variations;
-
colour differences;
-
slight packaging variations.
Likewise, grading opinions may legitimately differ between professional grading companies.
Such characteristics do not automatically constitute defects or lack of conformity where they remain consistent with the Product description and generally accepted industry standards.
This clause shall never apply to counterfeit Products or Products materially different from those ordered.
9.6 Exclusions
The statutory warranties do not cover damage resulting exclusively from:

misuse;

accidental damage;
-
improper storage;
-
excessive humidity;
-
excessive heat;
-
direct sunlight;
-
modifications performed after delivery;
-
normal wear and tear.
Nothing contained in this Article excludes liability for defects existing at the time risk transferred to the Customer.
ARTICLE 10 — LIABILITY
10.1 General Liability
The Seller shall perform its contractual obligations with reasonable care and in accordance with applicable law.
Nothing contained in these Terms excludes liability where such exclusion is prohibited by law.
10.2 Product Information
The Seller makes every reasonable effort to ensure that all information published on the Website is accurate.
However, occasional errors relating to descriptions, availability or pricing may occur despite reasonable precautions.
Where a material error affects an Order, the Seller shall promptly notify the Customer and provide the appropriate remedy.
10.3 Collectible Value
Trading cards are collectible products whose market value may fluctuate considerably over time.
Accordingly, the Seller makes no representation or warranty regarding:

future market value;

investment potential;
-
future rarity;
-
resale value;
-
grading outcomes;
-
future demand.
Nothing contained in this clause affects the Seller's obligation to supply authentic Products corresponding to their description.
10.4 Shipping Carriers
The Seller shall not be responsible for failures attributable exclusively to independent shipping carriers beyond the obligations imposed by applicable law.
10.5 Website Availability
Although every reasonable effort is made to ensure uninterrupted access to the Website, temporary interruptions may occur for maintenance, security reasons or technical incidents.
Such interruptions shall not, in themselves, constitute a breach of these Terms.
10.6 Limitation of Liability
To the maximum extent permitted by applicable law, the Seller shall not be liable for indirect or consequential losses suffered by Customers acting for professional purposes.
This limitation never applies where mandatory consumer protection legislation provides otherwise.
ARTICLE 11 — INTELLECTUAL PROPERTY
All content available on the Website, including but not limited to:

is protected by intellectual property laws.
Unless expressly stated otherwise, such content is either owned by the Seller or used under licence or other lawful authorisation.
No content may be reproduced, copied, distributed, translated, adapted or exploited without the Seller's prior written consent, except where permitted by law.
All trademarks, logos, characters, illustrations and other intellectual property belonging to publishers, manufacturers or licensors remain the exclusive property of their respective owners.
Their appearance on the Website serves solely to identify and market genuine products.
Nothing contained herein grants the Customer any licence or ownership right over third-party intellectual property.
ARTICLE 12 — PERSONAL DATA
The Seller processes personal data in accordance with:

ARTICLE 13 — FORCE MAJEURE
Neither party shall be liable for any delay or failure resulting from an event of Force Majeure as recognised under applicable French law.

armed conflicts;

terrorism;

pandemics;

Where such circumstances are temporary, the affected obligations shall be suspended for their duration.
Where performance becomes permanently impossible, the Contract may be terminated in accordance with applicable law.
ARTICLE 14 — GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by French law.
Where the Customer is a Consumer habitually residing outside France, mandatory provisions of the Consumer's local legislation shall continue to apply whenever they provide greater protection.
The parties agree to seek an amicable resolution before initiating legal proceedings.
Consumers may submit unresolved disputes to the consumer mediator appointed by the Seller following a prior written complaint.
Consumer Mediator
In accordance with the provisions of the French Consumer Code relating to the mediation of consumer disputes, Consumers who have first submitted a complaint directly to KingNorwe TCG and have not received a satisfactory response may refer the dispute, free of charge, to the consumer mediator appointed by KingNorwe TCG:

These Terms are available in both English and French.
The English version is provided for the convenience of international Customers.
In the event of any inconsistency between the English and French versions, the French version shall prevail to the extent permitted by applicable law.
Nothing contained in this clause shall deprive Consumers of any mandatory rights granted by the legislation applicable in their country of habitual residence.
